Terms of Service

By creating an account or using PromotingLeader ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and PromotingLeader, governed by the laws of the Republic of India. By accepting these Terms, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

PromotingLeader is a software-as-a-service (SaaS) platform that provides:

• AI-powered LinkedIn post and carousel generation using the A·B·C·D content framework.
• Content scheduling, approval workflows, and calendar management.
• Brand kit management, story bank, and content strategy tools.
• Analytics dashboard (using data you import; we do not access LinkedIn analytics directly).
• Community showcase and leaderboard features.

You may register using LinkedIn OAuth, Google OAuth, or an email one-time code. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at support@promotingleader.com if you suspect unauthorised access.

You may not share your account with others or create accounts on behalf of third parties without their consent. Each paid subscription is for one named individual or brand.

PromotingLeader offers Free, Pro, and Agency subscription plans. Paid plans are billed monthly or annually via Stripe. Prices are listed on our Billing page and may be in INR or USD as indicated.

• Free plan: Limited to the features and monthly post quota specified in the Free tier description.
• Paid plans: Billed in advance. Your subscription renews automatically unless you cancel before the renewal date.
• Cancellation: You may cancel at any time from the Billing page. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for unused days.
• Refunds: We offer a refund within 7 days of your first paid subscription if the Service is not working as described. Contact us at support@promotingleader.com. After 7 days, all charges are final.
• Price changes: We will give you 30 days' notice before changing your subscription price.

You agree not to use PromotingLeader to:

• Publish spam, misleading content, or content that violates LinkedIn's Terms of Service.
• Impersonate any person, brand, or organisation.
• Generate or distribute content that is defamatory, obscene, harassing, or illegal under Indian law.
• Scrape, reverse-engineer, or attempt to extract our source code, AI models, or proprietary prompts.
• Use the Service to build a competing product or service.
• Circumvent any rate limits, quotas, or access controls.
• Share your API credentials or auto-publishing access with third parties.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

Your content: You own all content you create, upload, or generate through the Service. By using our AI generation features, you grant us a limited, non-exclusive licence to process your content solely to provide the Service.

Our platform: PromotingLeader, the A·B·C·D content framework, our UI designs, AI prompts, and all platform code are our exclusive intellectual property. You may not copy, reproduce, or distribute them without our written permission.

AI-generated content: Under current Indian law, AI-generated content does not have a separate author. You are responsible for reviewing, editing, and taking ownership of all content before publishing. We are not liable for inaccuracies in AI-generated content.

Our integration with LinkedIn is governed by LinkedIn's API Terms of Use. We are authorised to publish content on your behalf only when you have explicitly approved it through our platform. We do not take any action on LinkedIn without your explicit instruction.

LinkedIn may revoke our API access at any time. If this happens, auto-publishing features will stop working. We will notify you promptly but are not liable for any disruption to LinkedIn-connected features.

LinkedIn does not provide impression or engagement data through standard OAuth. Our Analytics feature shows only data that you manually import via CSV. We do not fabricate or estimate metrics. Any numbers shown in the Analytics section reflect only what you have imported.

To the maximum extent permitted by applicable Indian law, PromotingLeader shall not be liable for:

• Indirect, incidental, special, or consequential damages.
• Loss of revenue, data, goodwill, or business opportunity.
• LinkedIn account suspensions, bans, or restrictions arising from your use of our auto-publishing features.
• Inaccuracies or errors in AI-generated content.
• Service interruptions beyond our reasonable control.

Our total aggregate liability for any claim arising from your use of the Service is limited to the amount you paid us in the 3 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for your purposes.

PromotingLeader is a content creation tool. Results on LinkedIn (followers, engagement, leads) depend on many factors outside our control, including LinkedIn's algorithm, your industry, and your posting consistency. We make no guarantees about business outcomes.

You agree to indemnify and hold harmless PromotingLeader, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights including LinkedIn's Terms of Service.

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms, abuse the platform, fail to pay subscription fees, or for any other reason at our sole discretion, with or without prior notice.

Upon termination, your access to the Service will stop immediately. We will retain your data for up to 30 days before deletion, giving you time to export it. Some data may be retained longer if required by law.

These Terms are governed by the laws of the Republic of India. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. Failing that, disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

If you are a consumer under the Consumer Protection Act, 2019, you retain all statutory rights available under that Act.

We may update these Terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and cancel your subscription before the change takes effect.
